In my custom theme I am using a background image. This image has a place for the title area. I would like the text to not overlap the title. Is there some way to vskip under a title or set the textheight or even override the beamer@frametitlebox or beamer@frametextheight to make the text never approach the header area of a beamer slide.

Please add a minimal example that illustrates your problem. I think you can fix it by changing the size of the frametitle box. – Matthew Leingang Dec 14 '10 at 14:41
The available height depends on the user beamer style. Which one are you using? – Martin Scharrer Feb 7 '11 at 23:26
